if I'm making a film can I used copyrighted music if I'm only going tosend it into film-festivals?

We are not lawyers, but only lowly film makers and this is NOT meant to be construed as legal advice in any way, shape or form but you can probably get away with it if it's a small festival. It is risky, however and most festivals require you to sign a release stating that you have rights to all the material in your film. However, if you are like most independent film makers, you are "judgement proof" which means that if someone did want to sue you, it wouldn't be worth their time because you have no money. They would just send you a cease and desist order. It's a little risky but hey, that's what underground film making is all about.
